Who pays your medical bills after a car crash?

On Behalf of | Oct 29, 2025 | Car Accidents

Right after a collision, treatment cannot wait, and neither can the question of who covers it. After all, medical providers generally do not take IOUs.

Who pays?

Massachusetts is a no-fault state. Your own auto policy’s Personal Injury Protection typically pays first, up to your policy limits, regardless of who caused the crash.

How PIP works

PIP generally covers reasonable medical expenses and a portion of lost wages up to the limit you purchased, often $8,000. Though, coordination with health insurance can change what PIP pays. The governing statute explains insurers’ obligations and medical payment priorities, which is located at Massachusetts General Laws, Chapter 90, Section 34M.

When bills exceed PIP

Unfortunately, PIP is not always enough. If injuries are serious or costs exceed PIP, your health insurance may step in, and you may pursue a bodily injury claim against the at-fault driver to recover uncompensated medical expenses and other damages.

Why early guidance helps

Coordinating PIP, health insurance and potential third-party claims can be confusing, especially when providers request assignments or lien notices. To make matters worse, there are also laws, like the statute of limitations, which can negatively affect your ability to make claims against third parties and statutes that regulate how insurance companies must manage these situations.

After an auto accident, start medical care promptly. This is the most important first step, which can include going to the hospital in an ambulance if the accident was severe enough. Next, notify your insurer, and always keep thorough records. If your injuries cross Massachusetts’ tort threshold or your losses exceed PIP, explore fault-based recovery options.
